Terms of Use & Legal Notice

1. Introduction

These Terms of Use ("Agreement") govern the use of the teleradiology and PACS platform ("Platform", "Service") operated by Minasoft Sağlık Teknoloji Yazılım Danışmanlık Ltd. Şti. ("Minasoft", "we", "us"). By using the Platform, you accept all terms and conditions in this Agreement.

If you do not accept these terms, you must not use the Platform.

2. Definitions

• "Platform": The teleradiology and PACS software system
• "User": Institutions, hospitals or individual users of the Platform
• "Customer": The institution that purchases the Platform license
• "Data": Medical images, reports and patient information processed on the Platform
• "Confidential Information": Platform source code, technical documentation and trade secrets

3. Scope of Service

The Platform provides the following services:

• DICOM image archiving and communication (PACS)
• Radiology reporting and workflow management
• HL7/FHIR integration
• AI-assisted image analysis (Beta)
• Cloud-based data storage and management

4. Conditions of Use

Users may use the Platform only for lawful medical imaging and reporting purposes, within the scope set out in the license agreement, and in compliance with the laws of the Republic of Türkiye.

The following actions are strictly prohibited:

• Copying, reverse-engineering or attempting to access the source code of the Platform
• Attempting to compromise Platform security
• Attempting unauthorized access to other users' data
• Using the Platform for unlawful purposes or sublicensing outside the license scope

5. Intellectual Property

All intellectual property rights, source code, design, logos, trademarks and content of the Platform belong to Minasoft. Users may not copy, distribute, modify or create derivative works of any content without written permission.

6. Data Privacy & Security

Medical data processed on the Platform is handled and stored in compliance with KVKK and GDPR; patient data is protected through encryption.

Medical images and patient data uploaded by Users belong to the relevant institution; Minasoft accesses such data only to provide the service.

Minasoft applies industry-standard security measures including TLS encryption, regular security updates, access control and regular backups.

7. Limitation of Liability

To the maximum extent permitted by law, Minasoft is not liable for indirect, incidental or special damages, data or business loss, platform interruptions, or issues arising from third-party services. Total liability shall in no case exceed the license fees paid in the last 12 months.

8. Indemnification

The User agrees to indemnify and hold Minasoft harmless against any claims, damages, losses, lawsuits and costs arising from use of the Platform or breach of this Agreement.

9. Licensing

The Platform is licensed under a separate License Agreement (Enterprise, Per-User or Per-Module). See the relevant License Agreement for details.

10. Support & Maintenance

Technical support and maintenance are provided under a separate Support Agreement: critical-issue support, regular updates, remote support, and training/documentation.

11. Termination

Minasoft may immediately terminate the agreement in case of breach of the terms, non-payment of license fees, actions threatening Platform security, or intellectual-property infringement.

Upon termination, access is ended immediately; user data is delivered if requested within 30 days.

12. Changes to the Terms

Minasoft may change these terms at any time. Changes take effect upon publication; significant changes are notified to registered e-mail addresses.

13. General Provisions

This Agreement is governed by the laws of the Republic of Türkiye; disputes are resolved in the Istanbul Courts and Enforcement Offices. The invalidity of any provision does not affect the others. The User may not assign rights and obligations without written consent.
